目前，由于所说的商业方法专利实际上大多是通过计算机系统实现的，而又都会以软件的形式表现出来，所以，一般将其称为商业方法软件（Software Related Business Methods Patent）也有称为e－patent，Internet Patent ,Computer-implemented Inventions, 而对于BMP（ Business Method Patent）的称谓，一般认为既包含了普通的商业方法专利又包括了与软件有关的商业方法专利，甚至多数情况下特指后者。
